Terms of Use

Please read these Terms of Use (“Terms”) carefully before using MomentVid (the “app”). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. The service

MomentVid provides tools to capture or import travel videos, organize them into trip chapters, crop and style them with scene-based frames and local effects, and export platform-oriented delivery sets to your device and photo library. The app is designed for offline, on-device processing and is not a full multi-track video editor.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the app. If you are under 18, you should use the app with permission from a parent or guardian.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use MomentVid for personal, non-commercial purposes in accordance with these Terms and the Apple Media Services Terms and Conditions (for apps obtained from the App Store).

You may not copy, modify, reverse engineer, decompile, or create derivative works of the app except as permitted by law or with our written consent.

4. Your content

You retain ownership of videos, images, text, and other material you create or import (“your content”). You are solely responsible for your content and for obtaining any rights, consents, or permissions needed to record, import, edit, and share it.

You agree not to use the app to create or distribute content that is illegal, infringing, harassing, defamatory, or otherwise objectionable.

5. Local storage and backups

Your content is stored on your device. You are responsible for backing up important files (for example, via iCloud Photos or a computer). We are not responsible for loss of data due to device failure, accidental deletion, or uninstalling the app.

6. Exports and third-party platforms

Export presets may reference common aspect ratios (for example, vertical story or widescreen formats). You are responsible for complying with the terms and policies of any platform where you publish exported videos. We do not guarantee acceptance or quality on any third-party service.

7. Permissions

Certain features require system permissions (camera, microphone, photo library). Your use of those features is also subject to Apple’s and your device’s permission settings, as described in our Privacy Policy.

8. No professional advice

Golden-hour hints and shot checklists are provided for convenience only. They are not professional photography, safety, or travel advice. Always follow local laws and stay safe while recording.

9. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the app will be uninterrupted, error-free, or that exports will meet your expectations or third-party requirements.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $10 IF THE APP WAS FREE.

11. Indemnity

You agree to defend, indemnify, and hold us harmless from claims arising out of your content, your misuse of the app, or your violation of these Terms or applicable law.

12. App Store terms

If you downloaded MomentVid from the Apple App Store, your use is also subject to Apple’s applicable store terms and policies. Apple is not responsible for the app or its content; Apple has no obligation to provide maintenance or support for the app.

13. Changes

We may update the app or these Terms. We will post updated Terms at this URL and change the effective date. Material changes may require your continued use to constitute acceptance. If you do not agree to updated Terms, stop using the app and delete it.

14. Termination

You may stop using the app at any time. We may suspend or discontinue the app or any feature if required for legal, security, or operational reasons.

15. Governing law

These Terms are governed by the laws of the jurisdiction where the developer is established, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.
